Renovation Recipes Contest
Official Rules
NO PURCHASE OR PAYMENT NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Eligibility
The Renovation Recipes Contest (the “Promotion”) is open only to legal residents of the United States (including District of Colombia) who have reached the age of majority in their respective jurisdictions at the time of participation (but who in all cases must be 18 years of age or older). Void in Guam, Puerto Rico, the U.S. Virgin Islands, and other U.S. territories and possessions and where prohibited by law. Employees of White Picket Media, Inc. or other companies associated with the Promotion as well as the immediate family (spouse, parents, siblings and children) and household members (people who share the same residence at least three (3) months out of the year) of each such employees are not eligible. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Timing
The Promotion Period begins on September 30, 2010 at 12:00 a.m. Eastern Time (“ET”) and ends on November 30, 2010 at 11:59 p.m. ET (the “Promotion Period”). Sponsor’s computer is the official time keeping device for this Promotion.
4. How to Enter
During the Promotion Period, visit www.kitchens.com and fill out the online entry form completely by providing your name, address, phone number and email address. Then follow the instructions to submit an original recipe by providing the ingredients and instructions (must be prepared by using one or more small appliances) to make the item (the “Recipe”). Your Recipe must be in one of the following five (5) Categories: 1) Beverages; 2) Appetizers; 3) Sides & Salads; 4) Entrees; and 5) Desserts. The Recipe submission may also contain a photograph. Such photograph cannot violate the rights of third parties. There is no limit on the number of Recipes an entrant may submit during the Promotion Period but each Recipe must be submitted separately. Recipe must be original, of entrant’s own style and creation. Recipe must not violate the rights of other parties. Recipe which judges determine to be offensive or defamatory will be disqualified. Participant assigns and transfers to Sponsor and KitchenAid all rights, title and interest to the Recipe and photo. Recipe must be in English. Although a Recipe may be posted on www.kitchens.com shortly after being received, its posting does not constitute the Sponsor’s decision or agreement that the Recipe is in compliance with these Official Rules and Sponsor reserves the right to remove the posting and disqualify the Recipe at any such time that Sponsor determines the Recipe does not comply with either these Official Rules.
5. Terms of Submission
By entering, you represent and warrant that (i) your entire Recipe is an original work by you and you have not copied or used other works in your Recipe without permission or right to do so; (ii) no person, other than you has any right, title or interest in any part of your Recipe; (iii) your Recipe will not infringe or violate any rights of any third party or entity, including, without limitation, trade secret, copyright and trademark, defamation, privacy and publicity, false light, idea misappropriation or any contractual rights; (iv) you have all the rights, licenses, permissions and consents necessary to submit the Recipe in accordance with these guidelines; and you are a legal US resident physically residing in the United States and are over the age of majority in your state of residence as of the time of your submission. Sponsor reserves the right to disqualify or refuse to post any Recipe at any time for any reason at its sole discretion. Entries must comply with all laws, rules, and regulations including, but not limited to, those concerning copyright, plagiarism, trade secrets, trademark, defamation and invasion of privacy. By entering, you agree that the Recipe becomes property of Sponsor and KitchenAid and will not be returned.
6. Winner Selection
All Recipes will be displayed on www.kitchens.com as they are received and available for public voting between December 1, 2010 and December 31, 2010. The five (5) Recipes in each category that receive the most votes will be selected as a Category Finalist. The Sponsor or its representative will then score the Recipe of each Category Finalist on the following criteria: (1) Originality; (2) Tastiness; (3) Easy to Prepare with Limited Time and Resources; and (4) Ability to Incorporate the use of a Small Appliance into the Recipe. The one (1) entrant in each Category that scores the highest will be declared the Category Prize Winner and win the Category Prize identified below in section nine. There will be a total of five (5) Category Prize Winners; one from each of the Categories: (1) Beverages; 2) Appetizers; 3) Sides & Salads; 4) Entrees; and 5) Desserts). The Sponsor will then evaluate the Recipe of each Category Prize Winner and select the one Recipe that is the best based on the criteria identified above. The one (1) Category Prize Winner that scores the highest will be declared the Grand Prize Winner and win the Grand Prize identified below in section nine. In the event of a tie between any two entries at any time during this process, the eligible prize winner will be selected based on score received for criteria (1), then (2), then (3), and finally (4). All decisions by the Sponsor are final and binding. Limit one (1) Category Prize per person.
7. Verification of Potential Winners
Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Winners will be announced on or about January 15, 2011. The potential winners will be notified by email after the date(s) of selection. The potential winners will be required to sign and return to Sponsor, within seven (7) days of the date notice is sent, an affidavit of eligibility, and liability/publicity release (except where prohibited) in order to claim his/her prize if applicable. If a potential winner of any prize cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. In the event that a potential winner is disqualified for any reason, Sponsor may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
8. Requirements of Potential Winners
Except where prohibited, potential winners may be required to complete and return an affidavit of eligibility and liability/publicity release (the “Affidavit/Release”) within fourteen (14) days of being notified. If a potential winner fails to sign and return the Affidavit/Release within the required time period, then the prize will be forfeited. Potential winners who are residents of the United States may also be required to provide their Social Security Numbers to the Sponsor for purposes of reporting their tax obligations to appropriate government authorities.
9. Prizes
Category Prizes: There will be five (5) Category Prize Winners (one (1) for each category). Each Category Prize Winner will receive a KitchenAid Artisan Series Stand Mixer with standard attachments (flat beater, dough hook, and wire whip). Category Prize Winners will be able to choose the color of their Mixer. Approximate retail value of this prize is $299.
Grand Prize: There will be one (1) Grand Prize Winner. The Grand Prize Winner will receive a suite of KitchenAid appliances that includes the following: Coffer Maker, Toaster and Countertop Oven. Approximate retail value of this prize package is $700.
For All Prizes: Odds of winning a prize depends on the number of eligible entries received during the Promotion Period and the quality of the Recipe compared to other entries. Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute any listed prize for one of equal or greater value for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use.
10. General Conditions
In the event that the operation, security or administration of the Promotion is impaired in any way for any reason, including, but not limited to fraud, virus or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; or (b) award the remaining prizes in a random drawing of all eligible entrants at the time of the impairment. The Sponsor is only responsible for awarding the number of prizes set forth above. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of the Promotion or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.
11. Release and Limitations of Liability
Except where prohibited, by participating in the Promotion, participant agrees to release and hold harmless the Sponsor, all companies associated with the Promotion, their related and affiliated companies, and each of their respective officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical errors related to computers, servers, providers or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected or undeliverable mail or e-mail; (e) errors in the administration of the Promotion; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participant’s participation in the Promotion or receipt or use of any prize. Except where prohibited, participant agrees that: (a) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred in participation, but in no event shall include attorneys’ fees; and (b) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
12. Disputes
Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than those concerning the administration of the Sweepstakes or the determination of winners, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate Illinois State Court located in Chicago, Illinois; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois.
13. Publicity
Except where prohibited, participation in the Promotion constitutes winners consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions, writings, and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
14 Entrant’s Personal Information
Except as entrants may be otherwise notified during the course of the Promotion, information collected from entrants is subject to the Sponsor’s Privacy Policy which is available here.
15. Results
For a list of winners or a copy of these Official Rules, please send a self-addressed, stamped envelope to Winners List - The Renovation Recipes Contest c/o Kitchens.com, 4611 N. Ravenswood, Suite 101, Chicago, IL 60640 no later than February 15, 2011.
